El presente artículo tiene por objeto estudiar pormenorizadamente el actual estatus jurídico del lobo ibérico tanto en la legislación de la Unión Europea como en la legislación nacional española, sin olvidar su previo estatus jurídico y las recientes modificaciones que le han sido aplicadas, así como las perspectivas a futuro. En este sentido, y ante las polémicas surgidas, se analizará reciente jurisprudencia del TJUE, en particular, la STJUE, 1ª, de 24 de julio de 2024, as. 436/22, la cual disipa todas las dudas en torno al estatus jurídico del animal, las consecuencias de su catalogación y posibles medidas aplicables. Con este propósito, se examinará con detenimiento la Directiva hábitats en lo que al canis lupus se refiere, los principios de precaución y cautela y el requisito de la evidencia científica en relación a la aplicación de medidas de gestión. Por último, pero no menos importante, se abordará sucintamente el recurso de inconstitucionalidad interpuesto por el Defensor del Pueblo de España contra la Ley 1/2025 de prevención de las pérdidas y desperdicio alimentario.
The present article aims to study carefully the current legal status of the Iberian wolf both European Union legislation and national Spanish legislation, without forgetting its previous legal status and recent modifications which have been implemented, as well as future prospects. In this regard, and in light of controversies have been arisen, recent case-law will be analyse, in particular, Judgment of CJEU (First Chamber) of 24th July 2024, c. 436/22, which dissipates all doubts regarding legal status of the animal, the consequences of its cataloguing, and possible applicable measures. To this end, Habitats Directive regarding canis lupus, the principles of precaution and caution and the requirement of scientific evidence concerning the implementation of management measures, will be examined. Last but not least, the appeal of unconstitutionality filed by the Spanish Ombudsman against Law 1/2025 on the prevention of food loss and food waste will be briefly addressed.
