La movilidad humana inducida por el cambio climático ha sido objeto de análisis reciente tanto por la Corte Interamericana de Derechos Humanos como por la Corte Internacional de Justicia, entregando ciertos lineamientos para abordar este fenómeno que carece de respuesta jurídica en el derecho internacional. Es así como nos proponemos identificar los criterios y determinar las obligaciones estatales que surgen en el contexto de movilidad debido al cambio climático que completan los estándares existentes en materia de derechos humanos.
Human mobility induced by climate change has been the subject of recent analysis by both the Inter-American Court of Human Rights and the International Court of Justice, providing certain guidelines for addressing this phenomenon, which lacks a legal response in international law. We therefore propose to identify the criteria and determine the state obligations that arise in the context of mobility due to climate change, which complement existing human rights standards.
