La incorporación del principio gender mainstreaming a la función de juzgar, plantea como una de sus tareas centrales combatir los estereotipos de género, para lo cual una herramienta es el uso del Derecho Internacional de los Derechos Humanos. A partir de lo anterior, el trabajo buscará analizar si en el caso del Poder Judicial chileno el uso de la categoría de género y su transversalización se queda en lo meramente cosmético en la senda por lograr decisiones libres de estereotipos de género
The incorporation of the gender mainstreaming principle into the judicial function presents combating gender stereotypes as one of its central tasks, for which the use of International Human Rights Law is a key tool. Based on this, this paper will analyze whether, in the case of the Chilean Judiciary, the use of the gender category and its mainstreaming remains merely cosmetic in the pursuit of achieving decisions free from gender stereotypes
