Transcurridos más de 40 años desde la entrada en vigor de la LORAFNA, se ha abierto un debate sobre la necesidad de proceder a su reforma. Este trabajo constituye una reflexión sobre los posibles cambios que podrían introducirse, respecto a cuestiones procedimentales y de fondo. En cuanto a lo primero, se propone atribuir la iniciativa para la reforma al Parlamento de Navarra, y estudiar su posible extensión también a las corporaciones locales, e incluso reconocer la iniciativa legislativa popular. Adicionalmente, se sugiere la estipulación de un quorum reforzado de aprobación de la reforma por parte del Parlamento de Navarra, pues es el único Estatuto de autonomía que puede ser reformado por mayoría simple, al no estar previsto requisito alguno al respecto. Asimismo, se reflexiona sobre la posibilidad de incorporar un referéndum final de ratificación popular, haciéndose hincapié en los posibles aspectos positivos e inconvenientes de ello. En cuanto a cuestiones de fondo, se propone la introducción de un lenguaje inclusivo en cuestiones de género, una mejor concreción del ámbito de leyes de mayoría absoluta, el reconocimiento de un catálogo de derechos sociales, (profundizando en ámbitos como los derechos de la población extranjera, el derecho a la vivienda o a la educación, y las ventajas de una gestión descentralizada de la diversidad en campos como el de la libertad de conciencia y religiosa), la supresión de los aforamientos, la especificación del ámbito de la circunscripción electoral en las elecciones al Parlamento Foral, y la inclusión de una normativa presupuestaria básica, que a día de hoy no existe en este Estatuto de Autonomía. El autor hace hincapié en la conveniencia de alcanzar un alto consenso en la reforma, prescindiendo de intereses a corto plazo y partidistas, sobre la base de la idea de recíproca lealtad constitucional, y el bien común, que permita avanzar en el autogobierno y la mejora del Estado de Bienestar.
More than 40 years have elapsed since the entry into force of the Organic Law 13/1982, of August 10th, on reintegration and improvement of the regime of the Fueros of Navarre, a debate has been opened on the need to proceed with its reform. This paper constitutes a reflection on the possible changes that could be introduced, both with respect to procedural and substantive issues. Regarding the first aspect, it is proposed to attribute the initiative for the reform to the Parliament of Navarre, and to study the possible recognition of it also to local entities, and even to recognize the popular legislative initiative. Additionally, the stipulation of a reinforced quorum for approval of the reform by the Parliament of Navarre is proposed, since it is the only Statute of Autonomy which can be reformed by a simple majority, because any additional requirement is not foreseen in this regard. Likewise, the possibility of incorporating a final referendum for popular ratification is reflected on, emphasizing the possible positive and inconvenient aspects of this. Regarding substantive issues, it is proposed to introduce inclusive language on gender issues, a better specification of the scope of regional laws which must be passed by absolute majority, the recognition of a wide catalogue of social rights, (in areas such as the rights of the foreign population, the right to housing or education, and the advantages of decentralized management of diversity in areas like the freedom of conscience and religion), suppression of the special jurisdictional subjection of the President and members of the regional Government and regional Parliament members, specification of the constituency in elections to the regional Parliament, and inclusion of basic budget regulations, which does not exist today in this Statute of Autonomy. The author emphasizes the necessity of reaching a high consensus in the reform, regardless of short-term and partisan interests, based on the idea of reciprocal constitutional loyalty and the common good, which will allow progress in self-government and the improvement of the Welfare State.
