La Ley 17/2022 llevó a cabo una profunda modificación del contrato predoctoral, regulado en el art. 21 de la Ley de la Ciencia. La modificación del régimen jurídico de esta modalidad contractual tuvo como efecto colateral que el Estatuto del Personal Investigador Predoctoral en Formación, en tanto que norma reglamentaria de desarrollo del art. 21 de la Ley de la Ciencia, quedara profundamente desfasado respecto a la nueva regulación legal. Asimismo, el Real Decreto-Ley 1/2023 procedió a modificar los incentivos previstos en caso de formalización de un contrato predoctoral, alterando lo previsto hasta el momento en la Ley de la Ciencia. En este contexto, el Real Decreto 1251/2024, de 10 de diciembre, por el que se modifica el Estatuto del Personal Investigador Predoctoral en Formación, ha venido a adecuar el desarrollo reglamentario del contrato predoctoral a las referidas modificaciones legales, al tiempo que se ha aprovechado la ocasión para introducir algunas mejoras de carácter más técnico. Precisamente, en este estudio se efectúa un análisis detenido del régimen jurídico del personal investigador predoctoral en formación tras los cambios introducidos por la Ley 17/2022 y el Real Decreto 1251/2024, con el fin de constatar sus virtudes y deficiencias
Law 17/2022 introduced a profound modification to the predoctoral contract, regulated in Article 21 of the Science Law. The modification of the legal framework for this contractual modality had the collateral effect of rendering the Statute of Predoctoral Research Personnel in Training, as the regulatory standard implementing Article 21 of the Science Law, profoundly outdated with respect to the new legal regulations. Likewise, Royal Decree-Law 1/2023 modified the incentives provided for in the case of the formalization of a predoctoral contract, altering the provisions previously established in the Science Law. In this context, Royal Decree 1251/2024, of December 10, amending the Statute of Predoctoral Research Personnel in Training, has adapted the regulatory framework for predoctoral contracts to the aforementioned legal amendments, while also taking the opportunity to introduce some more technical improvements. Specifically, this study carries out a detailed analysis of the legal regime for predoctoral research personnel in training following the changes introduced by Law 17/2022 and Royal Decree 1251/2024, in order to identify its strengths and weaknesses
