En sus orígenes teóricos, la democracia y el gobierno representativo aluden a dos modelos constitucionales en oposición: el de Rousseau y el de Montesquieu; el primero inspirado en las magistraturas romanas con instituciones como el mandato, la rendición de cuentas y la revocabilidad, la expresión de la voluntad del soberano directamente o a través de una autoridad controlable en todo momento por el pueblo; el segundo basado en la elección de un representante, en la división de poderes y en la exacerbación de la llamada libertad individual. Por otro lado, las constituciones de América Latina, a lo largo de su historia, estuvieron limitadas por la implementación casi invariable del modelo representativo de Montesquieu. A partir de 1999, esta realidad viene cambiando, con ligeras introducciones del modelo de democracia participativa, pero todavía de manera insuficiente, tergiversada y/o manipulada, tanto desde el punto de vista de su alcance como de su diseño institucional. Ante esta realidad, el modelo iuspublicístico latino-romano es un referente a tenerse en cuenta.
In its theoretical origins, democracy and representative government allude to two constitutional models in opposition: that of Rousseau and that of Montesquieu; the first inspired by the Roman magistrates with institutions such as the mandate, its revocable and controllable character, the expression of the will of the sovereign directly or through a judiciary of auditable authority; the second based on the election of a representative, the division of powers and the exacerbation of the so-called individual freedom. On the other hand, the constitutions of Latin America throughout their history have been limited in their development by the assumption, almost invariable, of Montesquieu’s model of advertising. From 1999 on, this reality has been changing with slight introductions of the model of participatory democracy, but this is still insufficient, both from the point of view of its scope and its institutional design. Faced with this reality, the Latin Roman iuspublicistic model, stands as a reference to take into account.
