  Para la efectividad del derecho de defensa es necesario que la parte tenga conocimiento del litigio y que el juzgado evite la indefensión en las comunicaciones. Es una circunstancia esencial de la comunicación que figure la dirección correcta de quien se pretende notificar y si esta se formuló incorrectamente por error del Juzgado, debe declararse la nulidad de actuaciones desde la situación al juicio para que la parte pueda presentarse.
