Cuando el contrato de trabajo se prepara a través de procedimientos dirigidos a facilitar el ingreso en el sector público surge la duda respecto de los tribunales competentes para conocer los problemas que puedan suscitarse. La jurisdicción social ha venido reclamando su propia competencia y finalmente así lo entendió la Sala de Conflictos del Tribunal Supremo. Posteriormente el legislador optó por remitir estos asuntos al orden contencioso, pero lo hizo a través de una Ley de Presupuestos Generales y el Tribunal Constitucional acabó declarando su oposición a la Ley Fundamental. La STS 815/2024 examina la competencia de litigio suscitado durante el periodo en que estaba vigente la atribución al orden contencioso, finalmente declarada inconstitucional.
When the employment contract is prepared through procedures aimed at facilitating entry into the public sector, doubts arise as to which courts are competent to hear the problems that may arise. The social jurisdiction has been claiming its own competence and finally this is how the Conflicts Chamber of the Supreme Court understood it. Subsequently, the legislator chose to refer these matters to the contentious order, but it did so through a General Budget Law and the Constitutional Court ended up declaring its opposition to the Fundamental Law. STS 815/2024 examines the jurisdiction of litigation arising during the period in which the attribution to the contentious order was in force, finally declared unconstitutional.
