Los Decretos de estado de excepción y su impacto en las Parlamentarias 6D-2015 es un ensayo que se escribe en pleno desarrollo del proceso electoral y que pretende verificar si el ejercicio de los derechos políticos se han restringido en las zonas afectadas, conformadas por nueve circunscripciones de 24 municipios fronterizos con Colombia, ubicados en los estados Amazonas, Apure, Táchira y Zulia que comprenden 21 curules de la Asamblea Nacional. Aun cuando no los limiten expresamente, los Decretos de estados de excepción impactaron negativamente el ejercicio de los derechos políticos durante las fases del proceso electoral, especialmente la que corresponde a la Campaña. La presencia de efectivos militares y la amenaza ante la suspensión de las garantías de derechos civiles representaron la ejecución de mecanismos intimidatorios hacia los electores. Una reforma constitucional y electoral deberá regular el carácter en sumo extraordinario de los estados de excepción durante las jornadas electorales.
The State Of Emergency Decrees and its impact on Parliamentary Elections D6-2015 is an essay that was written during the very electoral process. Its goal was to check if the political rights were restricted in the areas subject to the decrees, which covers 9 electoral districts on 24 border municipalities with Colombia, located at Amazonas, Apure, Táchira and Zulia states, and comprises 21 seats of the National Assembly. Even though they don’t constrain them expressly, the State of Emergency Decrees had a negative effect on the exercise of the political rights during the phases of the electoral process, mostly the corresponding to the campaign. The presence of military personnel and the threat of suspension of guarantees for civil rights were the means of intimidation towards the voters. A constitutional reform should regulate the exceptional nature of the emergency states during the election days.
