En este trabajo se analiza a quién protege el Reglamento MiCA, ya que ha desaparecido la mención al consumidor, que utilizaba la propuesta de Reglamento, y no es evidente el sistema de protección del titular minorista. Por ello se intenta asimilar la figura del titular minorista de criptoactivos con la de consumidor desgranando cada una de sus características, con el fin de aplicarle la normativa interna en materia de defensa de los consumidores y usuarios. También se estudian, por ser relevantes para la protección del titular minorista de criptoactivos, la información precontractual que hay que suministrarle, la obligación de elaborar un libro blanco, la regulación de las comunicaciones publicitarias y el reconocimiento del derecho de desistimiento.
This paper analyses to whom the MiCA Regulation protects, given that the reference to the consumer, which was used in the proposal for the Regulation, has disappeared in its final version, and the system for protecting the retail holders is not evident. An attempt is there fore made to assimilate the fi gure of the retail holder of crypto-assets with that of the consumer, breaking down each of their characteristics, in order to apply domestic consumer and user protection regulations to them. The pre-contractual information that must be provided, the obligation to prepare a white paper, the regulation of advertising communications and the recognition of the right of withdrawal are also studied, as they are relevant for the protection of the retail holder of crypto-assets.
