En la regulación de los algoritmos, la IA y la protección de datos la transparencia es el eje central de la misma. En este trabajo, se analiza el contenido de esas regulaciones y el alcance y contenido de las obligaciones de transparencia. A su vez, defendiendo la necesidad de las normas de transparencia para garantizar el ejercicio de los derechos de las personas trabajadoras, este trabajo sostiene que es insuficiente en el ámbito laboral. En este sentido, se critica que la transparencia se use como justificación para no establecer nuevos derechos materiales que garanticen la protección de las personas trabajadores frente a los retos presentados por la IA en el trabajo. Por último, se propone reforzar estas obligaciones de transparencia mediante presunciones que faciliten el ejercicio de derechos de las personas trabajadoras.
In the rules for the regulation of algorithms, AI and data protection, transparency is at the core of the regulations. In this paper, we analyze the content of these regulations and their importance. In turn, upholding the need for transparency regulations to ensure the exercise of the rights of working people, this paper argues that it is insufficient in the labor sphere. In this sense, it is criticized that transparency is used as a justification for not establishing new material rights to ensure the protection of workers in the face of the challenges presented by AI at work. Finally, it is proposed to reinforce these transparency obligations by means of presumptions that facilitate the exercise of workers’ rights.
