En este trabajo se analizan los principios de progresividad y pro persona en la jurisprudencia federal mexicana y de la Corte Interamericana de Derechos Humanos (CORTE IDH). Asimismo, se analizan los dos principios a partir de la interpretación que han tenido en el ámbito jurisprudencial, sobre todo, a partir de la reforma constitucional en materia de Derechos Humanos, publicada en el Diario Oficial de la Federación mexicana (DOF), el 10 de junio de 2011. La metodología utilizada, fue: la dogmática convencional, la dogmática constitucional, la dogmática jurídica, la dogmática jurisprudencial, así como los métodos analítico, sintético, descriptivo y documental con el fin de analizar y conocer las posturas interpretativas de los referidos Tribunales.
This paper analyzes the principles of progressivity and pro persona in Mexican federal jurisprudence and the Inter-American Court of Human Rights (IACtHR). Likewise, the two principles are analyzed based on the interpretation they have had in the jurisprudential field, especially since the constitutional reform on Human Rights, published in the Official Gazette of the Mexican Federation (DOF), on June 10, 2011. The methodology used was: conventional dogmatics, constitutional dogmatics, legal dogmatics, jurisprudential dogmatics, as well as analytical, synthetic, descriptive and documentary methods in order to analyze and know the interpretative positions of the aforementioned Courts.
