El huésped-consumidor con domicilio en la UE o en Colombia, México o Argentina realiza contantemente contratos de intermediación digital con plataformas en línea para alojamientos turísticos con sede social en otros Estados. En caso de reclamación, la cuantía de las pretensiones, al tratarse small claims, pueden disuadir al huésped-consumidor de presentar una reclamación judicial, pero el escenario puede cambiar si puede acceder a mecanismos de resolución de conflictos (ADRs) económicos o gratuitos, rápidos y eficaces que le permitan gestionar en línea su reclamación. La UE y los Estados seleccionados de Latinoamérica conceden a los consumidores herramientas extrajudiciales para que puedan obtener una compensación por daños, sin embargo, no todos los consumidores pueden acceder a ellas y se crea un escenario de protección internacional que depende de criterios como el domicilio del consumidor, el lugar de sede o establecimiento de la plataforma, la especialidad del ADR en consumo, entre otros. Esta breve investigación pretende exponer este escenario y mostrar la protección internacional comparada de los huéspedes-consumidores en materia de ADRs.
The guest-consumer with domicile in the EU or in Colombia, Mexico or Argentina constantly enters into digital intermediation contracts with online platforms for tourist accommodations with registered offices in other States. In the event of a complaint, the amount of the claims, being small, may dissuade the guest-consumer from filing a legal claim, but the scenario may change if they can access inexpensive or free, fast and efficient dispute resolution mechanisms (ADRs) that allow them to manage their complaint online. The European Union and selected Latin American States grant consumers extrajudicial tools so they can obtain a compensation for damages. However, not all consumers can access them, and several scenarios of international protection are created, which depend on criteria such as the domicile of the consumer, the place of registered office or establishment of the platform, the specialty of the ADR in consumption, among others. This brief research aims to expose this scenario and show in a comparative perspective the international protection of consumer-guests in ADRs matters.
