Han pasado ya 10 años desde la aprobación el 4 julio 2012, y su posterior publicación en el DO de 27 julio 2012, del Reglamento de la Unión Europea 650/2012 relativo a la competencia, la ley aplicable, el reconocimiento y la ejecución de las resoluciones y los actos auténticos en materia de sucesiones y a la creación de un certificado sucesorio europeo (en adelante Reglamento 650/2012). El objetivo de este trabajo radica en mostrar los criterios seguidos por el Tribunal de Justicia de la Unión Europea (TJUE), antes conocido como Tribunal de Justicia de las Comunidades Europeas (TJCE), a la hora de aplicar el Derecho internacional privado europeo sucesorio.
Ten years have passed since the approval on July 4, 2012, and its subsequent publication in the DO on July 27, 2012, of the Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession (hereinafter Regulation 650/2012). The objective of this work is to show the criteria followed by the Court of Justice of the European Union, formerly known as the Court of Justice of the European Communities, when applying European private international inheritance law.
