El programa de compliance penal, como medio de acreditar el cumplimiento del deber de supervisión, vigilancia y control de riesgos penales por parte de la empresa, representa un elemento que incide directamente en el fundamento de la responsabilidad penal de la persona jurídica. Su ausencia facilita la condena del ente jurídico, pero su existencia puede provocar, si cumple con los requisitos normativos formales y materiales, la exención de la responsabilidad penal de la persona jurídica. En el presente artículo se exponen las distintas tesis sobre la naturaleza jurídica de estos programas de cumplimiento y se analiza la conveniencia de que éstos —siempre que puedan ser considerados como idóneos y eficaces para prevenir el delito investigado, o reducir significativamente el riesgo de su comisión— , desplieguen sus efectos exoneratorios durante la fase de instrucción.
The criminal compliance program, as a means of accrediting compliance with the duty of supervision, vigilance and control of criminal risks by the company, represents an element that directly affects the grounds for the criminal liability of the legal entity. Its absence facilitates the punishment of the legal entity, but its existence may lead, if it complies with the formal and material regulatory requirements, to the exclusion of the criminal liability of the legal entity. This article sets out the different theses on the legal nature of these compliance programs and analyses the appropriateness of these programs —provided they can be considered as suitable and effective to prevent the crime under investigation, or significantly reduce the risk of its commission— causing the exemption of legal person´s criminal liability during the pre-trial phase.
