Los delitos contra la Seguridad Social constituyen uno de los sectores más olvidados de la dogmática penal, siempre a la sombra de los delitos fiscales. Sin embargo, en los últimos años, en virtud de las reformas legales, y en parte, gracias a la expansión del Derecho penal, ha crecido el interés por el estudio de los elementos propios de estos tipos penales, como remedio para condenar el fraude recaudatorio que afecta al sistema de Seguridad Social, y así, poder alcanzar un verdadero Estado Social de Bienestar. En este trabajo, realizaré, en primer lugar, una aproximación a los delitos contra la Seguridad Social; para proceder, a continuación, y por separado, al análisis del sujeto activo y del partícipe en los dos delitos fundamentales. El delito de defraudación a la Seguridad Social es un delito especial propio, cuyo sujeto activo sólo puede ser el obligado al pago de las cuotas, de modo normal, el empresario; y junto a él, son posibles las formas de participación, en ellas, distinguiré la figura del operador bancario y del asesor fiscal. Y en cambio, el delito de disfrute indebido de prestaciones es un delito común, cuyo sujeto activo puede ser cualquier persona. Este trabajo quiere ofrecer claridad en los elementos estudiados y, a la vez, ofrecer una serie de propuestas político-criminales.
Crimes against Social Security constitute one of the most forgotten sectors of criminal dogmatics, always in the shadow of tax crimes. However, in recent years, by virtue of legal reforms and, in part, thanks to the expansion of criminal law, interest has grown in the study of the elements of these criminal types, as a remedy to condemn the collection fraud that affects the Social Security system, and thus, to achieve a true Social Welfare State. In this paper, I will first make an approach to the crimes against Social Security, and then proceed, separately, to the analysis of the active subject and the participant in the two fundamental crimes. The crime of defrauding Social Security is a special crime of its own, whose active subject can only be the person obliged to pay the contributions, normally the employer; and together with him, forms of participation are possible, in them, I will distinguish the figure of the bank operator and the tax advisor. On the other hand, the crime of undue enjoyment of benefits is a common crime, whose active subject can be any person. This paper aims to provide clarity on the elements studied and, at the same time, to offer a series of political-criminal proposals.
