El delitode prevaricación judicial puede ser entendido como un mecanismo idóneo para garantizar la legalidad de la actuación de los jueces y de quienes realicen “funciones análogas”. Sin embargo, este delito tiene un escaso desarrollo por parte de los tribunales y de la doctrina nacional. Por ese motivo, deseamos contribuir a la discusión del sujeto activo del delito a través del concepto de jurisdicción delineado por el Tribunal Constitucional chileno. La idea que subyace es que el ejercicio de la función jurisdiccional constituye un criterio suficiente para identificar al sujeto activo del delito de prevaricación judicial.Palabras clave: delitos contra la administración de justicia; comportamiento judicial; jurisprudencia del Tribunal Constitucional
The crime of judicial misconduct for misapplication of the law can be considered as a proper mechanism to ensure the legal behavior of judges and of those who perform “analog functions”. However, the specific legal features of this crime have been scarcely developed in both national courts and doctrine. Therefore, we seek to contribute to the specific discussion on the perpetrator by examining the concept of jurisdiction given by the Chilean Constitutional Court. The idea underlying our reasoning is that the exercise of the jurisdictional function is a sufficient criterion when identifying the potential perpetrator of this crime.
