El presente artículo abordará el análisis de un Auto dictado por un Juzgado de Primera Instancia de competencia múltiple del interior de Córdoba, que desestimó la proceden-cia de una medida autosatisfactiva. El examen del resolutivo permite revisar los estrictos presupuestos de procedencia de la medida innominada receptada en el art. 484 del Códi-go Procesal Civil y Comercial de Córdoba, así como las distintas posturas jurisprudencia-les de la CSJN en torno a ella. Asimismo, se analizará la inclinación adoptada por el Tribu-nal ante la confrontación normativa del Régimen de Concursos y Quiebras (Ley 24.522) y los Tratados de Derechos Humanos y protección de las Personas con Discapacidad.
The present article will address the analysis of an order by a trial court of multiple power from Córdoba province who rejected the origin of a self-help measure. The analysis of the order allows the revision of the strict requirements of the unnamed measure’s origin in the article 484 from the Civil and Commercial Code Law of Córdoba as well as the judge-made stances of the Supreme Court of Argentina toward the measure. In addition, it will be analyzed the stance adopted by the court pertaining to the confrontation between the Bankruptcy Law (N° 24,522) and the Treaties of Human Rights and Disability protection.
