La Cámara de Apelaciones Civil y Comercial de Séptima Nominación de la ciudad de Córdoba revocó el decisorio de primera instancia que desestimó la indemnización del daño patrimonial por incapacidad por la proyección disvaliosa de la lesión que presentaba la hija de los accionantes en el plano laboral y en todas las demás actividades de la persona de contenido patrimonial. Para así decidir, el Tribunal de Alzada consideró que la incapacidad de la niña no se encontraba controvertida y que el resarcimiento derivado de la misma debía abarcar no solo la disminución de la aptitud de la damnificada para realizar tareas productivas, sino además la imposibilidad de realizar tareas útiles. La resolución del Tribunal de Segunda Instancia aporta elementos significativos en la valoración de los factores que integran el rubro de daño patrimonial por incapacidad.
