El 04 de diciembre de 2014 fue interpuesta una acción pública de inconstitucionalidad en contra del segundo inciso del artículo 20 CONA. Según la parte accionante, el artículo en mención se contrapone al art. 45 de la Constitución del Ecuador que garantiza el dere-cho a la vida desde la concepción. Una errónea interpretación del segundo inciso del art. 20 CONA podría impedir las intervenciones quirúrgicas desde la fecundación del óvulo hasta su nacimiento, aun cuando estas se realicen para garantizar el derecho a la salud y a la vida del que está por nacer. A pesar de que no existían mayores argumentos que justificasen la interposición de la acción, la Corte Constitucional resolvió declarar su ad-misibilidad y realizar un amplio análisis acerca de la obligación constitucional del Estado de garantizar el derecho a la vida y la salud desde la concepción. Mediante sentencia N° 50-14-IN/22 la Corte Constitucional denegó la demanda de inconstitucionalidad inter-puesta el 04 de diciembre de 2014 y confirmó la constitucionalidad de la norma. En el presente comentario queda en evidencia la posición que asume la Corte Constitucional del Ecuador a la luz del nuevo Estado de “derechos” y el régimen del “Buen vivir”.
On December 4, 2014, a public action of unconstitutionality was filed against the second paragraph of article 20 CONA. According to the plaintiff, the article in question is contrary to Article 45 of the Constitution of Ecuador, which guarantees the right to life from conception. An erroneous interpretation of the second clause of article 20 CONA could prevent surgical interventions from the fertilization of the ovum until its birth, even when they are performed to guarantee the right to health and life of the unborn child. Despite the fact that there were no further arguments to justify the filing of the action, the Constitutional Court decided to declare it admissible and made a broad analysis of the constitutional obligation of the State to guarantee the right to life and health from conception. By judgment No. 50-14-IN/22 the Constitutional Court denied the unconstitutionality action filed on December 04, 2014 and upheld the constitutionality of the norm. This commentary shows the position assumed by the Constitutional Court of Ecuador in light of the new State of "rights" and the regime of "Good Living".
