En el fallo comentado, se presenta un recurso de protección contra ISAPRE Banmédica, por aplicar un factor de riesgo por cada miembro del grupo familiar, lo que afecta, según la recurrente, el precio base del plan de salud. Se argumenta que esto va en contra de la interpretación correcta de las normas y menciona la inaplicabilidad de la tabla de factores según una sentencia previa del Tribunal Constitucional en 2010. Se alega, que la actuación de la ISAPRE viola garantías constitucionales y se solicita que se acoja el recurso, ordenan-do a la ISAPRE considerar solo el valor del plan base para todo el grupo familiar y restituir los montos pagados en exceso. La sentencia divide la controversia en tres aspectos: la legalidad o arbitrariedad de utilizar una tabla de factores de riesgo que altere el precio del plan de salud contratado, la legalidad de considerar el número de beneficiarios o cargas adicionales al determinar el precio final del contrato individual de salud, y la legalidad de los factores de riesgo y su cuantía establecidos por la ISAPRE, especialmente en el caso de una nueva carga menor de dos años, junto con el planteamiento final del voto disidente.
In the aforementioned ruling, an appeal for protection is filed against ISAPRE Banmédica, for applying a risk factor for each member of the family group, which, according to the appellant, affects the base price of the health plan. It is argued that this goes against the correct interpretation of the rules and mentions the inapplicability of the table of factors according to a previous ruling of the Constitutional Court in 2010. It is alleged that the ISAPRE's actions violate constitutional guarantees and it is requested that the appeal be upheld, ordering the ISAPRE to consider only the value of the base plan for the entire family group and to reimburse the amounts paid in excess. The judgement divides the controversy into three aspects: the legality or arbitrariness of using a table of risk factors that alters the price of the contracted health plan, the legality of considering the number of beneficiaries or additional charges when determining the final price of the individual health contract, and the legality of the risk factors and their amount established by the ISAPRE, especially in the case of a new charge of less than two years, together with the final approach of the dissenting vote.
