The Court must rule on the constitutionality of an order for the hospital admission of a pregnant woman for the control of the final stage of pregnancy and, if necessary, the labor induction, due to an increased risk of intrauterine fetal death; against her will to carry out a home birth. This context highlights the existence of a conflict between fundamental rights to personal freedom and personal and family privacy of the woman, and a constitutionally protected good: the life and health of the unborn child. Its solution results in the limitation of the rights of the pregnant woman, even without having granted her an audience. This is supported by the Constitutional Court because it is a measure with a legal basis, proportional to the purpose of protection pursued and justified in a situation of extreme urgency.
