Se ha debatido ampliamente sobre el papel de la legislación en la definición de la naturaleza de los regímenes esclavistas en las Américas y su función como objeto de lucha posesclavista. En este contexto, el presente trabajo aborda un estudio que busca realizar un análisis de la esclavitud como fenómeno jurídico durante el período esclavista. Aunque existió la llamada Ley Eusébio de Queiroz, que formalmente decretó el fin de la esclavitud, en realidad, e hecho no ocurrió. La institución de la esclavitud encontró su fin definitivo solo treinta y ocho años después, con la promulgación de la Ley Áurea. Es interesante observar cómo la misma ley que en un momento consolidó la esclavitud se convierte en un instrumento de lucha contra el racismo. Por este motivo, se analizaron los ordenamientos jurídicos brasileños, tanto los del período mencionado como los posteriores a la Constitución de 1988.

Much has been discussed about the role of legislation in defining the nature of slave regimes in the Americas and their function as an object of post-slavery struggle. In view of this, the present work deals with a study that seeks to carry out an analysis of slavery as a legal phenomenon during the slavery period, a period in which, although there was the so-called Eusébio de Queiroz Law, which formally decreed the end of slavery, in fact, this did not happen, with the institute of slavery only having its definitive end thirty-eight years later, already with the enactment of the Lei Áurea, and as the same law that at one time consolidated slavery, becomes an instrument of struggle against racism, reason through which the Brazilian legal systems were analyzed, such as those of the referred period, as well as the law after the 1988 Constitution.
