A pesar de la modernización que en el ámbito de las Administraciones Públicas introdujeron las Leyes 39/2015 y 40/2015, lo cierto es que el Real Decreto 625/2014, de 18 de julio, mantuvo el “modus operandi” común que venía siguiéndose de cara a la emisión de los partes médicos de baja, confirmación de la baja y alta. La experiencia del Covid-19 evidenció la necesidad de adaptar la incapacidad temporal al proceso de digitalización para así evitar los engorrosos trámites burocráticos. El tema de la incapacidad temporal cabe, igualmente, relacionarla con el uso desmedido y abusivo que, hoy día, se hacen de las nuevas tecnologías, de ahí que no sea tan extraño encontrarnos a trabajadores de baja por esta causa o que acudan enfermos al puesto de trabajo. Lo cual evidencia la necesidad de adoptar medidas más garantistas e incisivas que respeten el derecho a un trabajo decente. Y es que, de lo que se trata es de que se cumplan con la finalidad última para la que se creó la prestación por incapacidad temporal.
