Este trabajo pone de manifiesto la evolución que ha experimentado el permiso de maternidad en España desde su origen allá por el año 1900 hasta la actualidad, teniendo en cuenta que las diferentes fases históricas que ha experimentado el país han marcado el camino a seguir (guerra, ideales políticos, dictadura), tanto a favor como en contra de estos derechos. Dividido en tres etapas muy diferenciadas entre sí, nos proporciona una visión global, en una primera, la aparición de los derechos de maternidad y lactancia durante la Revolución Industrial, momento en el cual la mujer se incorporó al mercado laboral en las fábricas, una segunda etapa coincidiendo con el franquismo donde se limitaron e incluso eliminaron algunos de estos derechos relegando el papel de la mujer al ámbito doméstico apartándola del ámbito laboral , desandando lo andado, llegando finalmente a una tercera etapa que coincide con el nacimiento de la democracia en nuestro país, recuperando los derechos perdidos e incluso ampliándolos a lo largo de décadas para facilitar no sólo la incorporación de la mujer al mundo laboral sino también asegurando su continuidad en el mismo adoptando medidas conciliadoras que permitan ser madre y trabajadora al mismo tiempo sin mermar ninguna de las facetas en favor de la otra. En esta última etapa hay que destacar las medidas adoptadas recientemente y las que en un futuro se pretenden adoptar provenientes de la nueva “Ley de Familias” cuyo anteproyecto fue aprobado en diciembre de 2022 por el Consejo de Ministros y que va a suponer un cambio revolucionario en los permisos de maternidad, lactancia y cuidado de menores, entre otros, con la finalidad de conseguir una conciliación real de la vida familiar y laboral, haciendo especial hincapié en las familias monomarentales y monoparentales cuya conciliación es arduo complicada.
This work shows the evolution of maternity leave in Spain from its origin in 1900 to the present day, considering that the different historical phases that the country has undergone have marked the path to follow (war, political ideals, dictatorship), both for and against these rights. Divided into three very different stages, it provides us with a global vision, in the first, the appearance of maternity and breastfeeding rights during the Industrial Revolution, when women joined the labour market in factories, a second stage coinciding with the Franco regime when some of these rights were limited and even eliminated, relegating the role of women to the domestic sphere, taking them away from the labour sphere, Finally, a third stage coincided with the birth of democracy in our country, recovering the rights lost and even extending them over the decades to facilitate not only the incorporation of women into the world of work but also to ensure their continuity in it by adopting conciliatory measures that make it possible to be a mother.

In this last stage, it is important to highlight the measures adopted recently and those to be adopted in the future from the new "Family Law" whose preliminary draft was approved in December 2022 by the Council of Ministers and which will entail a revolutionary change in maternity, breastfeeding and childcare leave, among others, with the aim of achieving a real reconciliation of family and work life, with special emphasis on single-parent and single-parent families whose reconciliation is arduous and complicated.
