Se discute sobre la legitimación para iniciar el procedimiento tendente a rebajar la edad general de jubilación cuando concurren circunstancias gravosas en el tipo de actividad desarrollado. La sentencia comentada analiza a situación anterior a modificarse la Ley General de Seguridad Social (2022) y examina el régimen aplicable. Concluye que ese procedimiento para rebajar la edad de jubilación podía instarse de forma unilateral (por los sindicatos o por las patronales). Advierte, sin embargo, que ya no es así en la actualidad. Asimismo, esta sentencia permite recordar los criterios de la Sala Cuarta, especialmente subrayando que la rebaja de la edad de jubilación es una figura excepcional y no puede ser objeto de interpretación extensiva o analógica. Se descarta la posibilidad de que individualmente pueda obtenerse ese beneficio, siendo imperativo en todo caso seguir el procedimiento reglamentariamente previsto (Real Decreto 1698/2011).
There is a discussion about the legitimacy to initiate the procedure aimed at lowering the general retirement age when there are burdensome circumstances in the type of activity carried out. The aforementioned judgment analyzes the situation prior to the amendment of the General Social Security Law (2022) and examines the applicable regime. It concludes that such a procedure to lower the retirement age could have been initiated unilaterally (by the trade unions or by the employers). He warns, however, that this is no longer the case today. This judgment also makes it possible to recall the criteria of the Fourth Chamber, especially by stressing that the lowering of the retirement age is an exceptional figure and cannot be subject to extensive or analogous interpretation. The possibility that this benefit can be obtained individually is ruled out, and it is imperative in any case to follow the procedure provided for in the regulations (RD 1698/2011).
