El desarrollo tecnológico conlleva que el Derecho deba adaptarse a las nuevas realidades que regula. Ante el desarrollo de los buques autónomos y no tripulados, surgen diferentes cuestiones acerca de su encaje en la normativa y el impacto que tendrán en el sector marítimo. Así pues, es necesario comenzar analizando el concepto de buque autónomo y buque no tripulado con el objetivo de establecer su encaje en la normativa, pues prescinden de la tripulación, un pilar esencial, hasta ahora, de la navegabilidad del buque. Puesto que el desarrollo de los buques no tripulados viene de la mano del desarrollo de los sistemas de Inteligencia Artificial, lo que ha generado el debate acerca de reconocer personalidad jurídica electrónica a dichos sistemas. Así, el estudio de la figura del porteador y sus elementos diferenciales se hace imprescindible con la finalidad de establecer si, en el caso de reconocer personalidad jurídica electrónica al buque, este podría alcanzar dicha posición contractual.
Technological development means that the Law must adapt to the new realities it regulates. In view of the development of autonomous and unmanned ships, different questions arise as to how they fit into the regulations and the impact they will have on the maritime sector. It is therefore necessary to begin by analysing the concept of autonomous and unmanned ships in order to establish how they fit into the regulations, as they dispense with the crew, an essential pillar, until now, of a vessel’s seaworthiness. Since the development of unmanned vessels goes hand in hand with the development of Artificial Intelligence systems, this has led to the debate on recognising the electronic legal personality of these systems. Thus, the study of the figure of the carrier and its differential elements becomes essential in order to establish whether, in the case of recognising electronic legal personality to the vessel, it could achieve this contractual position.
