La progresiva construcción de un “modelo europeo de justicia penal”, basado en un estatuto de los sospechosos y acusados, que sea equivalente y comparable entre los Estados miembros, representa la clave no solo para profundizar en el proceso de integración sino para la supervivencia de la Unión Europea como comunidad de derecho. Por ello, el presente trabajo aborda los principales avances, los límites del sistema y las perspectivas de futuro de la armonización. El objetivo es delimitar un cuadro del statu quo de la justicia en la Unión Europea y de sus tendencias con el fin de formular algunas previsiones sobre cómo podría y debería evolucionar este complejo ámbito y algunas recomendaciones para seguir avanzando en este camino. En particular, se considera que se deberían reformar algunos de los instrumentos vigentes, como la orden europea de detención, así como adoptar nuevas medidas para reforzar la protección del justiciable.
The progressive institution of a “European model of criminal justice”, based on a statute of suspects and defendants, which is equivalent and comparable between Member States, is the key not only for the integration but also for the survival of the Union as a community based on the rule of law. This article addresses the main developments, the limits of the system and the perspectives for the harmonisation. The aim is to provide an overview of the justice in EU and its trends with the purpose to formulate some forecasts on how this complex area could and should evolve and some recommendations for further developments. In this regard, it is very important to reform some of the existing instruments, such as the European arrest warrant, and to adopt new instruments to strengthen the protection of defendant.
