El Pacto Mundial para una Migración Segura, Ordenada y Regular es el primer acuerdo intergubernamental, elaborado bajo los auspicios de las Naciones Unidas, que abarca todas las dimensiones de la migración internacional de forma holística y completa. Se adoptó en una conferencia intergubernamental sobre migración en Marrakech, Marruecos, el 10 de diciembre de 2018. Este esfuerzo multilateral, se debe también por las líneas trazadas en la Declaración de Nueva York para los Migrantes Refugiados, adoptada en 2016, como un importante avance de las iniciativas globales para mejorar y alinear las políticas de los Estados en respuesta a los movimientos a gran escala de refugiados y migrantes. El Pacto mundial sobre migración, representa una oportunidad histórica para mejorar la cooperación internacional en materia de migración (particularmente la irregular) y para fortalecer la contribución de los migrantes al desarrollo sostenible. Aunque no es legalmente vinculante, el Pacto Mundial para una Migración Segura, Ordenada y Regular describe un marco de cooperación para gestionar mejor la migración a nivel local, nacional, regional y mundial. Recopila principios, derechos y obligaciones de los instrumentos de Derecho internacional existentes con respecto a la migración e identifica las mejores prácticas en todas las áreas de la migración. En el marco de sus 23 objetivos para la acción de los Estados, se analizarán también los compromisos que los Estados cuentan en la actualidad a través de otras obligaciones internacionales que pretenden abordar los retos relacionados con la migración irregular actual, su impacto en el abordaje del tráfico y la trata de personas, como así también, en el rol de las empresas en sus relaciones con el Estado en la gestión de migrantes.
The Global Compact for Safe, Orderly, and Regular Migration, is the first intergovernmental agreement, developed under the auspices of the United Nations, to cover all dimensions of international migration in a holistic and comprehensive manner. It was adopted at an intergovernmental conference on migration in Marrakech, Morocco, on December 10, 2018. This multi–lateral effort is also due on the lines outlined in the New York Declaration for Migrant Refugees, adopted in 2016, as an important advancement of global initiatives to improve and align states' policies in response to large–scale movements of refugees and migrants. The Global Compact on Migration represents a historic opportunity to improve international cooperation on migration and to strengthen the contribution of migrants and migration to sustainable development. Although not legally binding, the Global Compact for Safe, Orderly, and Regular Migration outlines a framework for cooperation to better manage migration at local, national, regional, and global levels. It compiles principles, rights, and obligations from existing international law instruments with respect to migration and identifies best practices in all areas of migration. Within the framework of its 23 objectives for State action, it will also analyze the commitments that States currently have through other international obligations that seek to address the challenges related to current irregular migration, its impact in addressing human smuggling and trafficking, as well as the role of businesses in their relations with the State in the management of migrants.
