Drawing on the debate on legal method and methodology that has characterised this journal on several occasions in the twentieth century, the author points to the relevance of adopting models from other fields of knowledge and disciplines for current law. In particular, European Better Regulation is examined as a paradigmatic example of an approach to law characterised by a growing influence of the so-called behavioural sciences, with a high degree of eccentricity or syncretism in the legal method behind a systematic use of metaphors.
Prendendo le mosse dal dibattito sul metodo e sulla metodologia giuridici, che ha caratterizzato questa Rivista a più riprese nel Novecento, l’A. richiama l’attenzione sulla rilevanza per i diritti vigenti del prestito di modelli di altri saperi e discipline. In particolare, viene esaminata la Better Regulation europea quale esempio paradigmatico di un approccio al giuridico caratterizzato da crescente influenza delle cosiddette behavioural sciences, in cui dietro a un sistematico ricorso a metafore, il metodo giuridico manifesta elevato eccletismo o sincretismo.
