Nuestro ordenamiento jurídico, ya desde la cúspide de nuestro Texto Constitucional, pasando por la normativa presupuestaria, administrativa, de transparencia, gasto público y contractual, en la que se incluyen las recientes disposiciones normativas Next Generation EU, en todas ellas se fijan objetivos primarios y básicos de eficiencia y eficacia de su gestión. Sin embargo, el momento de crisis en la que se encuentra nuestra sociedad ha demostrado que la realidad es otra, que tenemos una gran dificultad para poder verificar el cumplimiento de objetivos y una adecuada utilización de los recursos que se depositan en el sector público. Con este trabajo, se trata alertar y poner cuestión el porqué de esta situación y qué posibles medidas de control son precisas para que verifique el contenido normativo legislado y que no ha cumplido con las expectativas que la sociedad ha depositado en estas.
Our legal system, from the top of our Constitutional Text, through the budgetary, administrative, transparency, public and contractual expenditure regulations, which include the recent normative provisions Next Generation EU, All of them set primary and basic objectives for the efficiency and effectiveness of their management. However, the moment of crisis in which our society finds itself has shown that the reality is another, that we have great difficulty in verifying the fulfilment of objectives and the proper use of the resources that are deposited in the public sector.. With this work, we try to alert and question the reason for this situation and what possible control measures are necessary to verify the normative content legislated and that has not met the expectations that society has placed in them.
