La capacidad jurídica de las personas físicas se adquiere por el solo hecho de su nacimiento; el sujeto de dere- cho cuenta con capacidad de goce, la cual se refiere a la aptitud para ser titular de derechos y ser sujeto de obligaciones. En el caso de los menores, la capacidad presenta una restricción en cuanto al ejercicio de derechos, que bien pueden ejercer a través de sus representantes. En este artículo se analiza la manera en la que el ejercicio de los derechos del menor se vincula con el interés superior de la niñez en aquellos asuntos que son de su incumbencia. Se recurrió a información documental cualitativa y normativa de México, con el fin de profundizar en aquellos casos en los que el menor podría ejercer sus derechos por sí mismo, con la ayuda de equipos interdisciplinarios para su atención, protección, y orientación psicológica y emocional, debido a la evolución de sus facultades.
The legal capacity of natural persons is acquired bythe mere fact of their birth; the subject of law has thecapacity to enjoy, which refers to the ability to be theholder of rights and be subject to obligations. In the caseof minors, the capacity presents a restriction regardingthe exercise of rights, which they may well exercise through their representatives. This article analyzes the way in which the exercise of the rights of the minor issubordinated to the best interest in those matters oftheir concern. Qualitative and normative documentaryinformation from Mexico was used, in order to delveinto those cases in which the minor could exercise theirrights on their own, with the help of interdisciplinaryteams for their care, protection, and psychologicaland emotional guidance, due to the evolution of theirfaculties.
