En los últimos la Comisión Europea y el TJ por un lado, y el Estado polaco por otro están manteniendo un pulso por cuenta del Estado de Derecho y de la independencia judicial. Para ello, la Comisión y el TJ han recurrido al artículo 19.1.2º del TUE. Este artículo ha servido como base jurídica para impugnar la normativa polaca en materia de organización judicial y dentro de ella, la relacionada con el régimen disciplinario de sus jueces y tribunales cuando esta ha atentado a la independencia judicial. Por el momento, el régimen disciplinario de los jueces polacos ha sido cuestionado por la Comisión en dos procedimientos por incumplimiento. En el primero, el TJ condenó a Polonia en una sentencia de 15 de julio de 2021en relación con determinados aspectos referentes al régimen disciplinario de los jueces de los Tribunales ordinarios. En el segundo, el TJ ha condenado a este Estado por la adopción de nuevas medidas referentes al régimen disciplinario de los jueces de los Tribunales Ordinarios, pero también del TS y de lo Contencioso-Administrativo.
In recent years, the European Commission and the Court of Justice on the one hand, and the Polish State on the other, have been keeping a legal pulse regarding the Rule of Law and judicial independence. They have resorted to article 19.1.2º of the TEU. This article has been used as a legal basis to challenge polish regulations on judicial organisation and within it, those related to the disciplinary regime of its judges and courts when judicial independence has been threatened. At the moment, the disciplinary regime of Polish judges has been questioned by the Commission in two procedures of infringement. In the first one, the CJ condemned Poland in relation to certain aspects relating to the disciplinary regime of judges of the Ordinary Courts. In the second one, the CJ has condemned Poland for the adoption of new measures regarding the disciplinary regime not only of the Ordinary Courts, but also of the Supreme Court and the Contentious Administrative Courts.
