La Ley 7/2022, de 8 de abril, de residuos y suelos contaminados para una economía circular, ha supuesto un hito importante para las tasas locales, pues introduce, por primera vez, una tasa cuya imposición resulta obligatoria para los Ayuntamientos, pero de la que, sin embargo, poco o nada se regula. Se trata de imponer, antes de abril de 2025, una tasa que grave la generación de residuos por parte de los ciudadanos, en la que prime el principio de que “quien contamina paga”. Muchas son las dudas que genera esta tasa y muchos son los problemas con los que se van a encontrar los Ayuntamientos para su establecimiento, pues es difícil, con los actuales sistemas de gestión de residuos, individualizar los generados por cada ciudadano, en especial, en las grandes ciudades. A lo largo de este artículo vamos a intentar desgranar todos y cada uno de los problemas que se prevé que pueden generarse, poniendo de manifiesto las quiebras que presenta el tributo y que, a buen seguro, darán lugar a una gran conflictividad. Se atisba, por tanto, y si el legislador no lo remedia, un largo camino hasta llegar a la resolución final de todos los conflictos que se vayan generando.
Law 7/2022, of April 8, on waste and contaminated soils for a circular economy, has been an important milestone for local taxes, as it introduces, for the first time, a tax whose imposition is mandatory for municipalities, but of which, however, little or nothing is regulated. The idea is to impose, before April 2025, a tax on the generation of waste by citizens, in which the principle “pay as you throw” prevails. Many are the doubts that this tax generates and many are the problems that will be encountered by municipalities for its establishment, since it is difficult, with the current waste management systems, to individualize the waste generated by each citizen, especially in large cities. Throughout this article we are going to try to describe each and every one of the problems that are expected to be generated, highlighting the failures that the tax presents and that, for sure, will give rise to a great deal of conflict. Therefore, and if the legislator does not remedy it, there is a long way to go until the final resolution of all the conflicts that will be generated.
