El TJUE en la Sentencia de 15 de noviembre de 2022, asunto C-646/20, Senatsverwaltung für Inneres und Sport, Standesamtsaufsicht, ha afirmado que la disolución de un matrimonio en virtud del art. 12 del Decreto Ley italiano núm. 132 de 12 de septiembre de 2014, constituye una “resolución judicial” relativa al divorcio a los efectos del Reglamento 2201/2203. El Tribunal interpreta los dos elementos que deben cumplirse para que una decisión sobre divorcio no judicial sea considerada como “resolución”. En el presente trabajo se analiza como esos elementos se cumplen en las escrituras de divorcio autorizadas por notarios españoles y se estudia la nueva regulación del Reglamento 2019/1111 sobre la eficacia extraterritorial de los documentos públicos y acuerdos.
In the Judgment of 15 November 2022, in case C-646/20, Senatsverwaltung für Inneres und Sport, Standesamtsaufsicht, the Court of Justice of the European Union establishes that the dissolution of a marriage on the basis of Article 12 of Italian Decree-Law No 132/2014 constitutes a “judgment” within the meaning of article 2 of Regulation 2201/2003. The Court interprets the two elements that must be met for a non-judicial divorce decision to be considered a “judgment”. This paper analyzes how these elements are fulfilled in the Spanish notarial divorces and the new rules of the Regulation 2019/1111 on recognition and enforcement of authentic instruments and agreements.
