    Uno de los principios a los que debe atender la reforma procesal penal americana es el de seguridad jurídica, que se traduce en la certeza que debe tener el acusado de que sus derechos serán respetados por la autoridad actuante, y que, de producirse alguna afectación, deberá cumplirse con lo previsto en la ley para tener la menor afectación posible y restituir el derecho a su estado normal. Una forma de salvaguardar esta seguridad jurídica es el principio de non bis in idem, conforme al cual nadie puede ser castigado o procesado dos veces por un mismo hecho, en los casos en que se aprecie la identidad de sujeto, hecho y fundamento, con especial énfasis en el instituto de la cosa juzgada en el proceso penal

    One of the principles that should be viewed by the American criminal procedure reform is the judicial security that results in the certainty that the accused must have of how their rights will be respected by the acting authority and that if any infringement may occur, it must comply with the provisions of law in order to have the least affect possible and restore the rights to normal. One way of safeguarding that judicial security is the principle of non bis in idem [double jeopardy] under which nobody can be punished or prosecuted twice for the same act, where it is appreciated the identity of subject, act and rationale, with special emphasis in the Institute of res judicata in criminal proceedings
