La administración pública del Estado ecuatoriano, dentro del cual se encuentra el gobierno autónomo descentralizado municipal, ejercido por un alcalde o alcaldesa; el mismo que junto con el gobierno central, ejercido por un presidente o presidenta de la República, ambos tienen el deber primordial de garantizar a la sociedad ecuatoriana el bienestar y el desarrollo a la comunidad. En ese marco históricamente las aproximaciones doctrinarias del pensamiento del ser humano se establece la obligatoriedad de las personas a tributar recursos económicos a la administración del Estado para financiar la obra pública a favor de la población. El imperium jurídico, a través de la prerrogativa que tiene la administración pública del Estado, mediante normativa jurídica: constitucional, legal, reglamentaria y ordenazil; ha permitido instituir un Sistema Tributario Municipal, mediante el cual la administración local recauda impuestos establecidos por Ley; así como tasas y contribuciones especiales de mejoras, instituidas mediante Ordenanzas Municipal. En el caso Ecuatoriano la práctica tributaria se efectuó desde la época precolombina y colonial, la misma que era confiscatoria, discriminatoria e ilegítima; al nacimiento de la República del Ecuador, aunque la practica tributaria continuaba siendo impuesta en contra de la población más vulnerable y privilegiaba a los grupos de poder; se empezó a establecer normativas jurídicas de lo que hoy se constituye el sistema tributario del Ecuador. La metodología utilizada fue de enfoque cualitativo con un método analítico descriptivo, mediante la revisión doctrinaria y las normas jurídicas que constituye el imperium jurídico del tributo por el cual la ciudadanía debe cumplir con la normativa legitima.
The public administration of the Ecuadorian State, within which is the municipal decentralized autonomous government, exercised by a mayor or mayoress; the same that together with the central government, exercised by a president or president of the Republic, both have the primary duty of guaranteeing the well-being and development of the community to Ecuadorian society. In this framework, historically, the doctrinal approaches of the thought of the human being establish the obligation of people to pay economic resources to the State administration to finance public works in favor of the population. The legal imperium, through the prerogative of the public administration of the State, through legal regulations: constitutional, legal, regulatory and orderly; it has allowed the establishment of a Municipal Tax System, through which the local administration collects taxes established by Law; as well as rates and special contributions for improvements, instituted throughMunicipal Ordinances. In the Ecuadorian case, the tax practice was carried out since pre-Columbian and colonial times, the same one that was confiscatory, discriminatory and illegitimate; at the birth of the Republic of Ecuador, although the tax practice continued to be imposed against the most vulnerable population and privileged power groups; legal regulations began to be established for what is now the Ecuadorian tax system. The methodology used was a qualitative approach with a descriptive analytical method, through the doctrinal review and the legal norms that constitute the legal imperium of the tribute by which citizens must comply with the legitimate regulations.
