El presente trabajo trata sobre el concepto de dignidad como valor básico de los derechos humanos. Para ello, se divide en tres apartados; el primero relativo al valor jurídico-moral que se le otorga a la dignidad de todo ser humano, debido principalmente a la debilidad de los poderes y garantías del derecho internacional humanitario para la protección de los derechos humanos; en el segundo apartado, se traza un bosquejo del “valor de verdad” de la dignidad humana entendida como un “ideal regulativo”; en el tercer apartado, por último, se exponen algunos de los argumentos escépticos o diferentes de los dialógicos o convencionales que mantienen la idea regulativa de la dignidad, con la intención de abrir el debate actual sobre la dignidad, los derechos humanos y su eficacia internacional.
This paper deals with the concept of dignity as a basic value of human rights. For this, it is divided into three sections; the first relative to the legal-moral value that is given to the dignity of every human being, mainly due to the weakness of the powers and guarantees of international humanitarian law for the protection of human rights; in the second section, a sketch of the "truth value" of human dignity understood as a "regulative ideal" is outlined; Finally, in the third section, some of the skeptical arguments or arguments different from the dialogical or conventional ones that maintain the regulative idea of dignity are exposed, with the intention of opening the current debate on dignity, human rights and their international effectiveness.
