A partir del análisis de la nueva Ley 20/2022, de 19 de octubre, de memoria democrática, este artículo efectúa un balance crítico sobre la vulneración del derecho a la verdad de las víctimas del franquismo. A estos efectos revisa tanto los avances propiciados por la nueva ley, como los numerosos retos que quedan pendientes para saldar esta deuda histórica. En este sentido, al tiempo que realiza un alegato en favor de la justicia transicional, plantea la posibilidad de crear una comisión nacional de la verdad que contribuya al esclarecimiento de los crímenes.
Based on an examination of the new Spanish 20/2022 Democratic Memory Act of 19 October, this article provides a critical assessment on the violation to the right of truth to the victims of the Franco regime. It reviews both the progress made by this new act and the many challenges that still need to be addressed before this historical debt can be settled. Thus, while arguing for transitional justice, the paper also raises the question of setting up a national truth commission which would contribute to shed new light on the crimes.
