Article 89 of the Planning and Building Legal Framework provides that owners must carry out conservation works on their buildings and that the municipal authorities may order them to carry them out if they do not do so themselves. In real estate lease agreements, the owner is responsible for these works, even if the parties agree that the tenant will carry them out. This article argues that in real estate financial lease agreements, this obligation passes to the lessee by operation of law and, consequently, the municipal authorities cannot order the lessor to carry out conservation works on the leased building.
O artigo 89.º do Regime Jurídico da Urbanização e Edificação impõe que o proprietário realize obras de conservação do seu edifício, podendo essas obras ser ordenadas pelo município caso não sejam realizadas voluntariamente. No âmbito de contratos de arrendamento, essa obrigação legal continua a recair, em última instância, sobre o proprietário, ainda que seja contratualmente estipulado que as obras ficarão a cargo do arrendatário. No presente texto defenderemos que, nos contratos de locação financeira imobiliária, tal obrigação de conservação é legalmente transferida do proprietário/locador para o locatário e que, consequentemente, o município não pode ordenar ao locador que este realize obras de conservação.
