En los procesos de nulidad de sentencia ejecutoriada en el Ecuador existen diversos criterios sobre la asistencia del juez como legitimo contradictor dentro del juicio de nulidad de sentencia. El objeto del presente artículo consiste en determinar que el juez no solo es quien dicta una sentencia sino también es un testigo de la decisión judicial, dicho de otra manera, la decisión judicial de la administrador de justicia resuelve la pretensión del actor en base a los hechos probados y conectados con la norma jurídica, es indispensable la presencia del juez ante los procesos de nulidad de sentencia para que respalde su decisión judicial, de otra manera se estaría vulnerando el derecho a la defensa del juzgador. La metodología que se utilizó para el desarrollo del artículo fue de tipo analítico-descriptivo, se compararon definiciones, normativas constitucionales e infra constitucionales, además de criterios de autores conocedores del tema.
In the process of nullity of sentence executed in Ecuador there are several criteria on the assistance of the judge as a legitimate contradictory within the judgment of nullity of sentence. The purpose of this article is to determine that the judge is not only the one who dictates a sentence but is also a witness to the judicial decision, in other words, the judicial decision of the justice administrator resolves the actor's claim based on the proven facts and connected with the legal norm, it is essential the presence of the judge before the process of nullity of sentence to support his judicial decision, otherwise the right to the defense of the judge would be violated. The methodology that was used for the development of the article was of an analytical-descriptive type, definitions, constitutional regulations and constitutional infra were compared, in addition to criteria of authors familiar with the subject.
