El artículo aborda la evolución de regulación legal del derecho a las prestaciones sanitarias públicas por parte de migrantes en situación irregular. Se señala el pasaje de un régimen basado en el criterio de la residencia que permitía el acceso a esas prestaciones a uno basado en el criterio del aseguramiento que lo excluía (a partir de la reforma de 2012) y el regreso al régimen inicial (con la contra-reforma de 2018). Al mismo tiempo, se utiliza la regulación estudiada como punto de partida para reflexionar sobre los conceptos de universalidad y efectividad en relación con los derechos sociales.
The article analyzes the evolution of the legal regulation of the right of unauthorized migrants to public health benefits. It considers the transition from a regime based on the idea of residence that allowed access to these benefits to one based on the idea of insu-rance that excluded it (between 2012 and 2018) and the return to the initial regime (since the 2018 counter-reform). At the same time, this regulation is used as a starting point to reflect on the universality and effectiveness of social rights.
