The criminal offence of article 16 of Law 7492 is defined fundamentally in terms of the legal concept of a financial institution for criminal purposes. In view of the extent and complexity of this concept, doubts are common as to whether or not the provision of certain financial services should be included in this class. A debatable case is the usual concession of payroll loans by associations of public servants. The question is whether this service can constitute a crime in two alternative cases: (i) if the loans are made through an covenant with regular financial institutions, and the association works as an intermediary; and (ii) when the association operates the loans with its own resources. To answer this question, the article presents an analysis of the crime of article 16 of Law 7492 and especially of the legal concept of financial institution, including among its requirements the profitability, the openness to the market and the risk of the activity for the assets of third parties. In the case of agreements with banks, it is concluded that the intermediation does not configure a typical activity of a financial institution, when there is no availability of resources and, therefore, risk management by the association; when the intermediation is limited to certain subjects in at least one of the poles; or when the profit from the activity is exclusive to the bank. Distinguishing profit from capital remuneration, from the notion of legal fees, we arrive at the determination of the crime of usury, as abuse in the practice of lending with own resources, thus demarcating the limit of the concession of credit by the association itself.
O tipo penal do art. 16 da Lei 7492 é definido fundamentalmente em função do conceito legal de instituição financeira para fins penais. Em vista da amplitude e complexidade desse conceito, são comuns as dúvidas sobre a inclusão ou não da prestação de determinados serviços financeiros nesta classe. Discutível é o caso da concessão habitual de empréstimos consignados em folha de pagamento, por associações de servidores públicos. Indaga-se se esse serviço pode configurar crime, em dois casos alternativos: (i) se os empréstimos ocorrem por meio de convênio com instituições financeiras regulares, e a associação funciona como intermediária; e (ii) quando a associação opera os empréstimos com recursos próprios. Para respondê-lo, o artigo apresenta uma análise do tipo do artigo 16 da Lei 7492 e especialmente do conceito legal de instituição financeira, incluindo entre os seus requisitos a lucratividade, a abertura ao mercado e o risco da atividade para o patrimônio de terceiros. No caso dos convênios com bancos, conclui-se que a intermediação não configura atividade típica de instituição financeira, quando não houver disponibilidade do recurso e, portanto, gestão do risco pela associação; quando a intermediação for limitada a determinados sujeitos em pelo menos um dos polos; ou quando o lucro da atividade for exclusivo do banco. Distinguindo lucro de remuneração do capital, a partir da noção de juros legais, chega-se à determinação do crime de usura, como abuso na prática do mútuo com recursos próprios, demarcando assim o limite da concessão de crédito pela própria associação.
