El art. 183.2 de la LRJS conmina al juzgador a determinar prudencialmente la cuantía de la indemnización por el daño causado ante la lesión de un derecho fundamental. Esta regla le atribuye una amplia discrecionalidad que se agudiza cuando los lesionados son las organizaciones sindicales y el comité de huelga en la diferente forma de ejercer el derecho fundamental de huelga. Además, el recurso de suplicación permite la revisión del importe de la indemnización recogido en la sentencia de instancia si es irracional o desproporcionado, lo que obliga al órgano jurisdiccional superior a la búsqueda y aplicación de un criterio lógico siquiera para fundamentar en derecho tal revisión.
The art. 183.2 of the Ley reguladora de la jurisdicción social (Labour Courts Act) urges the judge to determine prudentially the amount of compensation for the damage caused by the infringement of a fundamental right. This rule gives it a wide discretion that is exacerbated when the injured are the trade union organizations and the strike committee in the different way of exercising the right to strike. In addition, the application allows the amount of compensation set out in the judgment of the court to be reviewed if it is unreasonable or disproportionate, which obliges the higher court to seek and apply a logical criterion even to justify such a review.
