La Ley 36/2011, de 10 de octubre, reguladora de la Jurisdicción social, ha ampliado el ámbito objetivo de los Juzgados y Tribunales del orden social dando cabida a toda una serie de procedimientos que anteriormente eran residenciados en el orden contencioso-administrativo. Dentro de estas nuevas demandas se incluye la impugnación frente a la liquidación al Tesoro Público que deben realizar las compañías que tramitan un despido colectivo, afectando mayoritariamente a las personas de cincuenta o más años. Tanto la propia figura de la aportación como el procedimiento, presentan toda una serie de particularidades que, en ocasiones, plantean no pocas dudas en su aplicación práctica. Partiendo de lo anterior, el presente artículo quiere poner el foco en el estudio de las singularidades del procedimiento que regula la Ley rituaria laboral en sus artículos 151 y 152.
Law 36/2011, October 10th, regulation of social jurisdiction, has extended the objective uses for Tribunals and Courts of the social order including several procedures that formerly took place in the administrave order. Within these new claims, it is include the lawsuit against the liquidation for the Public Treasury that companies have to assume when they apply for a collective dismissal, that speccially affects employees of fifty or more years of age. Both the legal regulation of the contribution its procedure show many particularities. Therefore, in some occasions, the practical implementation is bringing more tan a few queries to solve. All this in mind, this report aims to focus on the study of the specifics of this procedure which is ruled by the labor jurisdiction regulation in its articles 151 and 152.
