La sentencia a analizar trata el recurso de casación interpuesto por la Junta de Andalucía tras la no ratificación por el TSJ andaluz de la medida sanitaria que exige la presentación de certificado digital o prueba negativa para el acceso a establecimientos de ocio nocturno. Para resolver el recurso, el Tribunal Supremo acude al llamado triple juicio de proporcionalidad para comprobar la idoneidad, necesidad y proporcionalidad de la medida, según las circunstancias concretas. De acuerdo con este examen y con el precedente asentado por numerosas sentencias del mismo Tribunal, el Supremo resolvería en el mismo sentido que el Tribunal Superior de Justicia de Andalucía: confirma la no ratificación de la medida dada la insuficiencia de la justificación y datos aportados por la letrada de la Junta de Andalucía.
The judgement to analyze addresses the appeal in cassation brought by the government of Andalucía after the non-ratification by the High Court of Justice of Andalucía of a sanitary measure requiring the provision of either digital certificate or negative test for having access to nightlife venues. In order to solve the appeal, the Supreme Court resorts to the so-called triple proportionality test to verify whether the measure is suitable, necessary and proportionated, in accordance with the specific circumstances. After having made such analysis and considering the jurisdictional precedent established by several judgements of the same Court, the Supreme would solve the appeal in the same sense as the High Court of Justice of Andalucía: it confirms the non-ratification of the measure given the insufficient justification and data provided by the counsel of the government of Andalucía.
