El 8 de noviembre de 2019, la Comisión Interamericana de Derechos sometió a la jurisdicción de la Corte Interamericana de Derechos Humanos el caso Martina Rebeca Vera Rojas contra la República de Chile. La Comisión señaló que la controversia versa sobre las alegadas violaciones de derechos humanos cometidas por la falta de regulación, control y sistemas de reclamación adecuados para la fiscalización de la decisión de la aseguradora de salud (IsapreMasVida) respecto del levantamiento del régimen de hospitalización domiciliaria (RHD) que la niña Martina Rebeca Vera Rojas, diagnosticada con el síndrome de Leigh, requería de modo esencial para su supervivencia.
On November 8th 2019, the Inter-American Commission on Human Rights filed the case of Martina Rebeca Vera Rojas against the Republic of Chile to the jurisdiction of the Inter-American Court of Human Rights. The Commission indicated that the controversy deals with the alleged human rights violations committed due to the lack of regulation, control and adequate claim systems for the control of the decision of the health insurer (IsapreMasVida) regarding the lifting of the home hospitalization regime (HHR) that the child Martina Rebeca Vera Rojas required, as she was diagnosed with Leigh syndrome, thus requiring such HHR as an essential mean for her survival. Upon this situation, Chile presented the following preliminary objections; lack of exhaustion of domestic remedies; inadmissibility of the petitioner's complaint due to lack of a legitimate claim and finally the incompetence of the Court to hear possible violations of Article 26 of the Convention. Despite the State's argumentative efforts, the Inter-American Court of Human Rights held that the State failed to comply with its duty to regulate health services and, consequently, with its obligations to protect such rights.
