La posibilidad de transmitir bienes por un canal distinto al testamento y, por tanto, al margen de la sucesión mortis causa se plantea desde el momento en el que existen negocios en los que se establecen estipulaciones a favor de tercero para el caso de muerte del contratante. En este estudio se intenta resolver si dichas transmisiones se encuentran sometidas al derecho sucesorio, especialmente, su conexión con las normas que regulan la sucesión forzosa. A tal fin se analiza el artículo 88 de la Ley de Contrato de Seguro, norma que regula la relación del derecho del beneficiario del seguro de vida con el derecho de los legitimarios, así como la posible aplicación del contenido de dicha norma a otros instrumentos de previsión.
The possibility of transmitting assets through a channel other than the will and, therefore, apart from the mortis causa succession arises from the moment in which there are businesses in which stipulations are established in favor of a third party in the event of death of the contractor. It should be considered whether these provisions are subject to inheritance law and, therefore, to the system of forced succession. To this end, article 88 of the Insurance Contract Law is analysed. This norm regulates the relationship between the right of the beneficiary and the legitimaries, as well as the possible application of the content of the norm to other forecast instruments.
