La Sala de lo Civil del TS, en su Sentencia de 31 de marzo de 2022, reitera la contravención del orden público español del reconocimiento de la maternidad subrogada como título de atribución de la maternidad del comitente de un contrato de gestación subrogada. El autor elogia la toma de postura del TS, en línea con el CEPDHLF y con la jurisprudencia del TEDH, frente a los postulados defendidos, v.gr., por la DGSJyFP, y afirma que los contratos de gestación por sustitución entrañan una explotación de la mujer gestante y un daño a los intereses superiores del menor.
The private law division of the Spanish Supreme Court, in its judgment of 31 March 2022, reiterates its doctrine on the lack of validity of the surrogacy contract as grounds for attributing maternity to the intended mother. The author praises the Supreme Court's position, aligned to the ECHR and the case-law of the European Court of Human Rights, and against the arguments posed by, i.e., the Spanish Directorate General for Legal Certainty and Public Faith. The Supreme Court, followed by the author, asserts that surrogacy contracts entail the exploitation of the surrogate mother and that are harmful for the best interests of the child.
