La Sala Constitucional del Tribunal Supremo de Justicia ordenó realizar elecciones para Autoridades y Decanos incorporando a los empleados y a los obreros como electores en 2019. En su lugar, los rectores de AVERU, solicitaron la nulidad del artículo 34 de la Ley Orgánica de Educación por haber incorporado a estos electores, al contrario de lo que señala el artículo 109 de la CRBV. Sin responder a la solicitud de nulidad, la Sala Constitucional emitió una segunda sentencia, en 2020, ratificando su decisión, que hasta ahora, las Universidades no han acatado.
Se plantea la posibilidad de aprobar un Reglamento Electoral Transitorio que contenga un acuerdo para convocar elecciones y renovar las autoridades como parte de un proceso de relegalización y relegitimación de la Universidad, sometida actualmente a un estado de parálisis institucional.
The Constitutional Chamber of the Supreme Court of Justice ordered elections for authorities and deans, at 2019, incorporating employees and workers as voters. Instead, the rectors of AVERU requested the annulment of article 34 of the Organic Law of Education for having incorporated these voters, contrary to what is indicated in article 109 of the CRBV. Without responding to the request for annulment, the Constitutional Chamber issued a second ruling, at 2020, ratifying its decision, which the Universities have not complied with. The possibility of approving a Transitory Electoral Regulation that contains an agreement to call elections and renew the authorities as part of a process of relegalization and relegitimization of the University, currently subject to a state of institutional paralysis, is raised.
